MO magazine: murder in Dornbirn – human rights expert, Prof. Nowak contradicts the reasoning of the Minister of the interior Kickl

„Obviously, should not be distracted by misbehavior of the authorities“

Vienna (OTS) – In January, Minister Herbert Kickl was in a ORF-Report-Interview the human rights Convention in question, as he said, that the right of politics have to follow and it is not the policy of the law. The internationally renowned human rights expert Manfred Nowak in a comment in the current MO –magazine for human rights, the arguments Kickls to the murder of a senior asylum officials in Dornbirn for „not very convincing“.

„If someone convicted of serious offences, a ban on Residence has been issued, then he must of course be taken to prevent him or her from illegal entry. That he was not controlled at the border, obviously, is not in the asylum system or the ECHR, but the disappearance of internal borders in the EU,“ explains Nowak.

A fast-track procedure would have been, according to Nowak, the right decision: „as soon As the person in Austria, made an application for asylum, would have had to determine the authority that it had been imposed ten years ago, a ban on Residence. In such a case, the asylum request would have to be decided in a fast track procedure. Thus, he would have been allowed to be used for the preparation of deportation.“

For a little convincing Nowak considers that the person could be deported because of article 3 of the ECHR to Turkey, since he had obviously lived in the past years in Turkey. „He should really have given as a reason for Asylum, that he was afraid of the Turkey, for his life, because he had killed as Kurd, Turkish soldiers, then it is more than doubtful whether he was able to fulfil the requirements of the definition of Refugee of the Geneva refugee Convention,“ says the human rights expert.

The interior Ministry has set up, according to Nowak, „obviously misleading claims, just to get this terrible case as a justification for the evisceration of the international and European asylum law and the ECHR in the cold-blooded murder of the officers in Dornbirn ‚debt‘.“ With this line of argument should, obviously, of a failure of the Ministry of the interior under the authority authorities to be distracted, so Nowak.
